Terms of Service

Status: DRAFT — pending final legal review. The clauses below reflect crate's intent for the v1.0 API customer relationship; the language will be tightened before any paying customer signs. By using a ck_live_* key during the beta period, you agree to these draft terms; we'll notify you 30+ days before any material change.

These terms apply to authenticated use of the crate-api at crate.0xhoneyjar.xyz/api/v1/*. The public consumer surface (the /crate browsing page) has its own separate terms.

1. Service description

crate-api is a public, paid API for the hosaka music catalogue: faceted search, master enrichment, batch enrichment, and facet snapshot endpoints. Provided by Hosaka (a sole proprietorship operating as @hosaka-fm). For the avoidance of doubt: this service does not provide audio streaming, music licensing, or rights clearance — it provides DATA ABOUT music.

2. Attribution

Data displayed publicly that was retrieved via the crate-api must credit "Hosaka / crate" with a link to crate.0xhoneyjar.xyz. Internal-use applications (engines, models, analytics) are exempt.

3. Redistribution boundary

  • Per-query results may be cached client-side for ≤24 hours.
  • You may NOT republish bulk data dumps.
  • You may NOT use the API to bootstrap or train a competing music data product (no scraping the catalogue to build a clone).
  • You MAY use API responses to enrich your own product offering as long as the underlying response data is not exposed in raw form to third parties.

4. Fair-use ceiling

The published rate limits are firm. The "fair-use" soft floor on Sync tier (~5M calls/mo before the conversation) is a courtesy, not a contractual guarantee. We reserve the right to throttle individual keys + temporarily suspend access to protect the service.

5. No SLA in v1.0

We do not promise a contractual uptime SLA in v1.0. We publish actual availability + latency via /api/v1/health + the public status page (when launched). We aim for ≥99.5% uptime but make no guarantee.

6. Data quality

Catalogue data is sourced from the ridden + mirror producers (CC0 catalogue data + cube enrichment). We do not warrant accuracy, completeness, or absence of errors. The freshness.ridden_lag_s / freshness.mirror_lag_s fields in every response disclose data lag.

7. Compliance

You are responsible for compliance with your own jurisdiction's data laws (GDPR, CCPA, etc.). We do not transmit personal data via the API; the data is about MUSIC, not people. If your jurisdiction interprets "artist names" as personal data, your integration's data handling is your responsibility.

8. Payment + billing

Self-serve subscriptions are billed monthly via Stripe. Overage is charged in arrears per the published rates. Sync-tier subscriptions are invoiced under separate contract.

Payment failures trigger a 7-day grace window. After 7 days, your keys are suspended (API returns 402); a successful payment within or after the grace restores access immediately.

Subscription cancellation revokes all keys; revoked keys cannot be reactivated (you must sign up again to get new keys).

9. Termination

We may terminate access for: violation of section 3 (redistribution boundary), repeated rate-limit abuse beyond the fair-use ceiling, attempted unauthorized access to the API surface, or failure to pay invoices.

You may terminate at any time via the Stripe Customer Portal (self-serve) or by emailing your account contact (Sync tier).

10. Liability

The API is provided "as is." Hosaka's liability is limited to the amount you paid in the 12 months preceding any claim. Hosaka is not liable for indirect, consequential, or incidental damages.

11. Changes to these terms

Material changes are announced with 30+ days notice via email to your account contact + this page. Non-material changes (clarifications, formatting, typo fixes) may be made without notice.

12. Governing law

This agreement is governed by the laws of the State of Delaware, USA. Any dispute is resolved in the courts of the same jurisdiction.
